1. Definitions
   • The Company; - Avenue Luxury Narrowboat Hire
   • The Hirer;- The person signing the booking form
   • The Boat;- Boats owned by Avenue Luxury Narrowboat Hire 
2. Booking Agreement
   • A provisional booking may be made by phoning or emailing us. The boat will be held for 1Week. The booking will not be confirmed until the completed and signed booking form has reached The Company with a payment of 25% of the total hire fee.
   • The balance of the total hire fee must be received not later than six weeks before the holiday is due to begin.
3. Age Limitations and Company reservations
   • The company will not let a boat to individuals under the age of 18years old. If it is deemed necessary proof of age may be required.
   • The company reserves the right to refuse handover of the boat to any person whom in the company's opinion is deemed unsuitable to take charge of the boat. In this circumstance all monies paid will be refunded and the hirer will have no further claim.
   • The company may repossess the boat at any time if in its opinion the hirer or passengers nominated during handover are found to be behaving in a irresponsible manner or found to be putting the boat or its passengers at risk. In this circumstance no monies will be refunded and the hirer will remain liable for the total cost of the holiday, plus any damage caused to the companys boat or British Waterways Property.
   • If owing to circumstance beyond the company's control the company is unable to provide the boat and a suitable alternative cannot be made available, all monies paid by the hirer will be refunded and the hirer will have no further claim.
   • Stag and Hen parties will not be allowed to hire a boat at any time.
   • No live bait must be brought on to or kept in the boat at any time.
   • Only the Maximum amount of passengers the boat is designed to carry shall be allowed on the boat.
4. Navigation
   • The Company reserves the right to restrict navigation to the Gloucester & Sharpness Canal. The boat will only be allowed to exit this navigation to the River Severn on prior arrangement with the company. Failure to observe this rule will result in repossession of the boat by the company. In this circumstance no monies will refunded to the hirer and the hirer will have no further claim on the company. Further the Hirer will remain liable for any cost incurred in the recovery of the boat.
   • Delays; The Company regrets that it cannot be held responsible for any British Waterways programs or stoppages on the canal.
5. Hire Period, Handover and return of the boat
   • Arrival; The handover of the boat to the hirer will normally take place at 3.00pm.
   • The Hirer must advise the company if they are likely to be delayed till after 5.00pm.
   • Return; The boat must be returned and cleared by the hirer by 09.30am.
   • Failure to return the boat by the required time will result in a further fee equal to one days hire plus any other loss incurred by the company due to loss of hire.
   • The hire period shall be that quoted on the booking form.
6. Prices and Payment
   • The prices shown in the online booking information are inclusive of 1 full tank of fuel.
   • We endeavour to keep our online booking information as up to date as possible at all times, but reserve the right to change prices should it be necessary. The Hirer will be advised of any change at the time of booking.
7. Cleanliness
   • The Hirer is obliged to keep the boat in clean and tidy condition. If the company deems the boat has been returned in an untidy condition the hirer will incur an extra cleaning charge of £25.00.
8. Accidents, Repairs and Breakdown
   • The Hirer is in charge of the boat and is responsible for its safe Navigation.
   • In the event of an accident or damage to the boat other craft or property the Hirer must notify The Company with full details to include names and addresses of any witnesses or other persons and craft involved.
   • DO NOT ADMIT LIABILITY UNDER ANY CIRCUMSTANCE.
   • Any repairs or breakdowns are the responsibility of The Company and should not under any circumstances be put into the hands of any other company without the express permission of The Company.
9. Pets
   • Up to two small dogs are allowed on The Boat "Madison Avenue".
   • The hirer must bring their own pet blankets or baskets.
   • Pets may not under any circumstances lie on the beds or chairs.
   • Pets most not at any time be left on The Boat unattended.
10. Hirers Property
    • The Company regrets that it cannot accept liability for any loss or damage to the Hirers property.
11. Online Brochure
    • The Company will endevour to maintain the online brochure as accurate as possible. The Company reserve the right to change the advertised price should it be deemed necessary. The hirer will be informed of any change at the time of booking. 
12. Disputes
    • The Company will try to resolve any dispute with the hirer in an amicable way.
13. Boat Instruction and Safety
    • The Hirer and passengers undertake to receive instruction from a representative of The Company in boat handling and safety procedures.
    • The Hirer untakes to abide by the procedures given at the time of handover.
    • The Hirer will only be given handover of The boat when the Company representative is happy that the hirer is competent to maintain The Boat in a safe condition.
    • Cruising in the hours of darkness is not permitted.
    • Observe the speed limits.
    • Show courtesy to other users.
    • Observe all bylaws, navigation limits and instructions from British Waterways staff.
14. Complaints
    • Should complaints be received by The Company that the Hirer is not in compliance with any of the above The Company reserves the right to repossess The Boat. In this circumstance no monies will be refunded to the hirer and the hirer will have no further claim on the company.
